As of January 6, 2021, the FCA has banned the marketing and sales of all exchange-traded notes. These are known as the ETNs and derivatives and which deals with tradeable and unregulated crypto assets by organizations and brokers trading from the UK. Any retail trader managing existing positions can decide to disinvest or remain invested after January 6, 2021.
The FCA has decided that the crypto-derivative assets are unsuitable and dangerous for retail traders for many reasons.
An inspection conducted by the FCA in 2021 showed that several owners of crypto assets are usually knowledgeable about the product, are informed on the inadequate regulatory protection provided, and know the damage of price volatility. The 2681 participants involved provided sound evidence that this policy statement is rather misunderstood, which challenges the FCA's judgement of their misinformation.
To resolve these problems, the FCA decided to ban the distribution and sale of any crypto-derivatives like options, futures, CFDs, and ETNs by every broker based in and delivering to the UK. The FCA estimated that there will be savings of about £53 million for the retail traders as a result of the ban. Despite this ban, you can still purchase other cryptocurrencies and Bitcoins directly. The ban is mainly for products which follow the rates of cryptocurrencies and not institutional crypto-derivative traders.
The goal of the FCA ban is to protect traders in the following ways:
The FCA ban obeys the 2019 FCA Consultation searching industry research on the adequacy of providing crypto derivatives to retail traders. About ninety-seven percent of the participants disagreed with the FCA on the ban, stating that the reasoning lacks evidence and is disproportionate. Several investors and traders have also mentioned that the ban is not likely to prevent scammers from targeting traders via social media and calls.
Nevertheless, several investment companies have accepted the change, stating that the risks involved with the crypto-derivatives are too complicated to evaluate. A few have also treated crypto-derivatives trading as speculation, instead of a tenable investment. However, overall, while the responses to the ban were mixed, many are hopeful that this change would create a more conducive trading environment for all parties.
