We found 11 online brokers that are appropriate for Trading Ireland Cryptocurrency Investment Platforms.
Cryptocurrency is growing in popularity. It is a new technology that seeks to disrupt the current financial system, which is based on FIAT money. The EBA classifies a crypto asset as any asset that fulfils these two requirements: it must rely on cryptography; it must be distributed via ledger technology. Ledger technology is also related to the asset’s value. The asset is not issued by any regulatory central bank, nor is it backed up by any banking entity. The asset can be used for investing, for preservation of value, and to access different services.
Crypto assets can be transferred digitally via ledger technologies. There are different types of crypto assets: cryptocurrencies, such as Bitcoin, Eretheum, Litecoin etc., as well as investment tokens which are like dividends but for cryptocurrencies. There are also utility tokens which can be exchanged for a particular service or product but cannot be used as a form of payment. These types of assets are not recognised in Ireland as FIAT money.
Currently, there are no clear regulations on cryptocurrency in Ireland. There are different approaches to different types of crypto assets. For instance, stable coins are valued in relation to real assets, such as FIAT money. At the moment, there are no clear strict policies for stable coins, but it is expected that there will be harsher regulations for these in the future.
Regarding classic crypto assets such as Bitcoin, there is no clear regulation, and the definition for these assets followed by banks is that they are unregulated, and investors need to be careful due to their high volatility. With regards to utility tokens, there is no pressure on them and banks do not treat them as financial assets. The main quality that provides a token with security is whether the token can serve as a transferable security or not. Security tokens are closer to debt financial derivatives and equity tools, so banks are calling for them to be regulated.
Crypto assets are still required to comply with some other requirements in Ireland and Europe. There is the Money Laundering Directive, which requires that European countries monitor and try to identify malicious activity with any type of virtual currency. These are known as AML/CTF policy requirements. There is no strict application of such policies in Ireland, as they are only on paper for now and have not been fully voted into power.
Also to be taken into consideration in Ireland is GDPR regulation. Crypto assets may be forced to comply with these regulations as cryptocurrencies store data and can be used to identify a user in the blockchain from an IP address. GDPR involves the storage and handling of data that comes from web browsing and any applicable digital data that can be used to identify users. This directive applies in all EU countries.
There are also payment services regulatory regimes, or PSD2, to take into account. This form of regulation involves money transferring services and money transmission. Companies that use these coins to transfer money may be subject to PSD2 rules as an electronic means of transfer.
There is also the electronic money directive, or EMD2. Any crypto asset can fall under this regulatory framework if it fills the requirements of an electronic money provider or electronic money user. The directive would force any company that uses such practices to obtain authorisation from EMD2.
There are no prohibitions indicated within the Irish law concerning the owning of crypto. Depending on the type of currency and its use, a holder may be required to apply for specific licenses to hold or use these assets. Such is the case for stable coins, which serve more as a financial derivative. Then there are money funds that, depending on the applicable law situation, may be prohibited or allowed to hold crypto in their portfolio. If one holds crypto, they might be forced to sign additional paperwork and obtain other relevant licenses. An example of such funds is the UCITS funds.
A special case regarding the ownership of crypto is inheritance. All cryptocurrencies are treated as personal items and are thus part of the deceased’s estate.
Initial Coin Offering involves fund raising by issuing digital tokens that are exchanged for FIAT money. Depending on the structure of the firm raising the ICO, there are laws applicable on a case by case basis that involve these entities. If the coins are used as financial instruments, they might be forced to comply with the Prospectus Directive, MiFID 2 laws, AIFMD requirements, or AML/CTF laws. The Central Bank of Ireland warns customers to be cautious when speculating in ICOs.
Cryptocurrency is treated in the same way as any other form of foreign currency. Its taxation depends on the nature of the business, the parties involved, and the applicable tax rate for the transaction in place. There is the applicable VAT for services and goods sold by suppliers. There are examples where exemption from VAT is enforced. Stamp duty tax is not applicable to crypto.
The process of creating cryptocurrency is called mining. There are no laws regarding mining in Ireland, but there are concerns regarding the environment’s effects of mining. This is because mining takes a toll on the electrical system and it uses lot of electrical power.
There are no requirements regarding custom declarations regarding crypto. All crypto assets are exempt from declaration when entering the Ireland territory.
Crypto is popular in Europe and is growing increasingly in this popularity. Its use allows borderless transfers and transfer of significant wealth. There is no clear regulation regarding crypto for the time being, bu the government is pushing for stricter regulation laws in the future.
