Contract for Differences (CFDs) are popular worldwide because they let traders trade on speculated up or down price movement (no real owning of the asset PRICE ONLY either way up or down, trading against your CFD broker). When I first began advising international traders who were relocating to the United States in 2025, many of them arrived with the same assumption I had seen for years. They believed they could continue trading CFDs exactly the way they traded Nasdaq CFDs, Gold CFDs, or EUR/USD CFDs back home. I remember several traders telling me they had open CFD positions on their phones during the flight and thought they could simply reconnect and continue trading once they landed in the U.S.

But the shock hits fast. CFD trading is strictly illegal for U.S. residents. This still catches newcomers off guard even in late 2025. Many of the traders I worked with had been actively trading assets that were incredibly volatile throughout 2024 and 2025. Bitcoin, for example, started 2024 near $44,000 and pushed above $100,000 by December 2024. Throughout 2025 it remained highly active, trading in a wide band between the mid $50,000s and the low $80,000s depending on inflation data and shifting interest rate expectations. Gold continued its massive climb as well. After setting new record highs near $2,800 per ounce in late 2024, it continued rising during 2025 and spent much of the year trading between $3,000 and $3,200 as investors looked for safety. Nvidia was another example I often brought up with traders. It traded above $1,100 per share before its 10 for 1 stock split in mid 2024 and by 2025 the post split price kept rising, moving from around $120 in early 2025 to well above $150 as AI demand stayed strong.

These assets were extremely attractive to CFD traders around the world, so it is understandable why so many people arriving in the United States expect to continue doing what worked for them abroad. But the U.S. regulatory environment does not allow it. Moving into 2026, this rule is not expected to change. U.S. regulators continue to focus on transparency, investor protection, and strict oversight, which means traders relocating to America need to transition away from CFDs and toward fully regulated alternatives such as stocks, options, futures, and SEC registered crypto platforms. Understanding these rules is essential to avoid compliance issues and to adapt smoothly to the realities of trading inside the United States.

Why CFD Trading Is Not Allowed in the USA

CFDs are banned for all U.S. residents under SEC and CFTC regulations. These agencies require all leveraged trading products to be transparent, exchange traded, and standardized. CFDs, however, are high risk, over the counter (OTC) instruments, often offering leverage as high as 1:500.

U.S. regulators focus on protecting retail traders from excessive leverage and opaque pricing. In 2024, regulators even tightened rules around crypto derivatives due to volatility caused by events like the Bitcoin halving and rapid ETF inflows.

Ive personally seen traders attempt to continue CFD trading after relocating to the U.S. only for their accounts to be frozen immediately when logging in from a U.S. IP address. In one case, a client was mid position on a Gold CFD when their European broker forced the position to close after detecting a U.S. login.

Other countries enforce similar restrictions Belgium and India have outright bans. But in my experience, the U.S. is by far the strictest when it comes to enforcement.

Even though CFDs are illegal, U.S. traders have access to a wide range of regulated derivatives that offer leverage, speculation, and hedging but with far more transparency.

When clients move from these regions to the U.S., they often need to restructure their entire trading strategy especially if they rely heavily on high leverage intraday trading.

At this point, there is virtually no chance CFDs will become legal in the U.S. anytime soon. Compliance officers Ive spoken with have made it clear: allowing CFDs would require massive regulatory changes in leverage rules, OTC transparency, and consumer protection laws.

The U.S. system is built around exchange traded, standardized products and CFDs simply dont fit the model.

CFD Trading With a Green Card or Foreign Residency

If you live in the U.S. even temporarily you legally cannot trade CFDs. This includes:

Ive seen multiple clients lose access to their CFD accounts immediately after updating their residential address to a U.S. location. In some cases, brokers froze withdrawals until proof of non U.S. residency was provided.

3. Margin Trading: Traders can use regulated leverage to buy stocks or ETFs. While leverage is lower than CFDs, its far safer and more transparent.
